Terms of Use

These terms cover your use of the Proxv app on iPhone, iPad, Mac and Apple TV and the Proxv Unlimited subscription. They're written to be read, so please take a few minutes to go through them.

In short: Proxv is a client app. It doesn't include or sell servers, and you are responsible for the servers you add and for using them lawfully. Connecting requires a Proxv Unlimited subscription, which is billed and managed by Apple and renews automatically until you cancel.

1. Agreement

Proxv is developed and published by Kamil Misiag, an individual developer based in Poland ("we", "us"). By downloading or using Proxv, you agree to these Terms of Use and to Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms add to the Standard EULA; where they differ, these terms apply to the extent permitted by the Standard EULA and by law.

If you don't agree, please don't use the app.

2. What Proxv is

Proxv is a client application that connects your device to proxy and VPN servers that you add, for example from a provider, your workplace, a friend, your own server, or servers shared publicly online. It creates a device-wide tunnel and sends your apps' traffic to the server you select.

  • We don't provide, sell, operate or recommend any servers.
  • We don't guarantee that any server works, is fast, is secure, or keeps your data private. The operator of a server can see the traffic that passes through it.
  • Whether a connection works also depends on your network, your device's operating system and the server's configuration, none of which we control.

3. Your responsibilities

You agree to:

  • use Proxv in compliance with the laws that apply to you, including laws in the country where you use it and the countries your traffic passes through;
  • respect the rules of networks you connect from, such as your employer's or school's, and the terms of the servers and providers you use;
  • only add and use servers you are entitled to use;
  • not use Proxv to commit or facilitate illegal activity, to infringe others' rights, to attack or disrupt networks or services, or to distribute malware or spam;
  • not copy, modify, reverse engineer, decompile or redistribute the app, except where the law expressly allows it.

You are responsible for choosing the servers you trust. Free servers shared online are run by unknown third parties; use them at your own risk and avoid sending sensitive information over connections that aren't separately encrypted.

4. Proxv Unlimited subscription

Adding, importing and testing servers is free. Connecting requires a Proxv Unlimited subscription. A subscription bought with your Apple Account works in Proxv on your iPhone, iPad, Mac and Apple TV signed in with the same Apple Account.

Plans and free trial

Proxv Unlimited is available as a monthly or yearly auto-renewing subscription. The yearly plan starts with a 14-day free trial for eligible new subscribers. Current prices for your region are shown in the app and in the App Store before you confirm a purchase.

Billing and renewal

  • Payment is charged to your Apple Account at confirmation of purchase or, if you start a free trial, when the trial ends.
  • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
  • You can manage or cancel your subscription anytime in your Apple Account's subscription settings. Canceling stops future renewals; you keep access until the end of the period you've paid for.
  • Any unused portion of a free trial is forfeited when you purchase a subscription.

Refunds

Purchases are processed by Apple, so we can't issue refunds directly. You can request a refund from Apple at reportaproblem.apple.com. Any statutory right of withdrawal you have as a consumer is exercised through Apple under Apple's terms.

Price changes

If we change the price of a subscription, Apple will notify you in advance and, where required, ask for your consent before the new price applies.

5. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Proxv on Apple devices that you own or control, as permitted by the Usage Rules in the App Store Terms of Service. The app and its design, code and brand remain our property. Proxv includes open-source components, which are licensed under their own terms; nothing in these terms limits your rights under those licenses.

6. Privacy

Proxv has no accounts and collects no analytics. How the app handles data is explained in our Privacy Policy, which forms part of these terms.

7. Changes and availability

We work to keep Proxv reliable, but we may update, change or remove features, for example to keep up with operating system changes, App Store rules or protocol developments. We don't promise that the app will be uninterrupted or error-free, or that any particular protocol or server will keep working. If we ever discontinue Proxv, we'll stop selling new subscriptions and give reasonable notice in the app or the App Store where possible.

8. Warranties

To the extent permitted by law, Proxv is provided "as is" and "as available", without warranties of any kind beyond those required by law. In particular, we don't guarantee that using Proxv will make you anonymous, bypass any particular network restriction, or protect you against every threat.

If you are a consumer, you keep all rights that mandatory consumer law gives you, including statutory rights regarding the conformity of digital content and services. Nothing in these terms limits those rights.

9. Liability

To the extent permitted by law:

  • we are not liable for the servers you add, for the conduct of their operators, or for content and services you access through them;
  • we are not liable for indirect or consequential losses, or for loss of profits, data or business opportunities;
  • our total liability to you for any claim related to Proxv is limited to the amount you paid for Proxv Unlimited in the 12 months before the claim arose.

These limits don't apply to liability for intentional misconduct or gross negligence, for death or personal injury, or to any liability that cannot be limited or excluded by law.

10. Termination

You can stop using Proxv at any time by deleting the app and canceling your subscription in your Apple Account. We may end your license if you materially breach these terms. Sections that by their nature should continue, such as liability limits and governing law, survive termination.

11. Apple

These terms are between you and us, not Apple. Apple is not responsible for Proxv or its content, and has no obligation to provide maintenance or support for it. If Proxv fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for Proxv. Apple is not responsible for addressing claims relating to Proxv, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection claims, or claims that it infringes a third party's intellectual property rights; we are responsible for those to the extent required by these terms and by law.

You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Governing law

These terms are governed by the laws of Poland. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of your country of residence.

13. Changes to these terms and contact

We may update these terms, for example when we add features or when the law changes. We'll publish the new version on this page with a new effective date and, for material changes, let you know in the app or in the App Store release notes before they take effect. If you keep using Proxv after the changes take effect, the updated terms apply.
